1. Purpose and Scope of This Disclaimer
This Health & Safety Disclaimer applies to all information, assessments, scores, recommendations, and other content provided through the HowPure mobile application (the “App”), operated by MB “BD Consulting”. This disclaimer supplements our Terms of Service and should be read in conjunction with those Terms.
This disclaimer covers all App features, including but not limited to: ingredient safety scores, per-ingredient risk levels, caution flags, personalized ingredient warnings, alternative product suggestions, allergy and sensitivity flagging, persona-based assessments, and any future features that provide health- or safety-related information.
2. Nature of Information Provided
2.1 Informational Only
All content in the App, including the overall product safety score (0–100), per-ingredient risk levels (No Risk, Low, Moderate, High), and caution flags, is provided for general informational and educational purposes. This information is not intended to diagnose, treat, cure, or prevent any disease or health condition, nor is it intended to replace professional judgment.
2.2 How Our Assessments Work
HowPure’s ingredient assessments are derived from:
- Publicly available scientific literature and safety studies
- Regulatory classifications from EU (EC Regulation 1223/2009), and other jurisdictions
- Our proprietary algorithm that evaluates ingredient safety based on available data
- Community-contributed data (user-submitted products and reviews)
These assessments represent a simplified summary of complex scientific data. They do not account for every possible variable that may affect how a product interacts with your individual biology, skin, or health status.
2.3 Concentration and Formulation Limitations
Cosmetic product safety depends significantly on the concentration of ingredients within a formulation, the interaction between ingredients, and the specific application method. While HowPure strives to provide the most accurate assessment possible:
- Exact ingredient concentrations are often proprietary and not publicly disclosed by manufacturers. Our assessments may rely on estimated concentrations.
- The same ingredient may be acceptable at one concentration but irritating or harmful at another.
- Ingredient interactions within a formulation can alter the safety profile of individual ingredients.
- Manufacturing processes, product age, and storage conditions may affect product safety in ways the App cannot evaluate.
3. Specific Feature Disclaimers
3.1 Safety Score and Risk Levels
The product safety score (0–100) and per-ingredient risk levels (No Risk, Low, Moderate, High) are simplified representations designed for quick reference. A high score or a “No Risk” classification does not guarantee that an ingredient or product will not cause an adverse reaction in your individual case. A low score or “High risk” classification does not necessarily mean the ingredient will cause harm at the concentration present in a given product. These scores and labels should be treated as one data point in your decision-making process, not as a definitive safety assessment.
3.2 Caution Flags
Caution flags identify ingredients that warrant additional attention based on factors such as known sensitization potential, regulatory restrictions in certain markets, or evolving scientific findings. A caution flag is informational and does not indicate that the ingredient is unsafe at the concentration used in a given product. Always read the full product label and consult a healthcare professional if you have specific concerns.
3.3 Personalized Warnings
Personalized warnings based on your ingredient profile (persona, sensitivities, ingredients to avoid, lifestyle preferences) are generated by matching your profile preferences against known ingredient properties. These warnings:
- Are only as accurate as the profile information you provide
- Cannot account for sensitivities or allergies you have not disclosed or are unaware of
- Do not replace patch testing or professional allergy testing
- May not capture all potential irritants or allergens for your individual situation
3.4 Allergy and Sensitivity Flagging
The App identifies known allergens based on EU regulatory lists (Annex III of EC Regulation 1223/2009) and commonly reported sensitizers. However:
- Not all allergens are captured in regulatory lists; new allergens are identified regularly
- Cross-reactivity between ingredients is not fully mapped in the App
- Individual allergy thresholds vary significantly and the App cannot account for your specific sensitivity level
- The App does not detect contamination or trace ingredients that may be present due to manufacturing processes
If you have known allergies or suspect an allergic reaction, consult an allergist or dermatologist. In the event of a severe allergic reaction (anaphylaxis), seek emergency medical attention immediately.
3.5 Alternative Product Recommendations
Product recommendations (generic alternatives in Pure and personalized alternatives in Pure+) are suggestions based on ingredient profiles and user preferences. A recommended product:
- May still contain ingredients that cause individual adverse reactions
- Has not been individually tested or endorsed by HowPure
- May have a different formulation than what is reflected in our database
- Should still be evaluated independently, including by reviewing its full ingredient list and performing a patch test if you have sensitive skin
4. Database Accuracy and Limitations
The HowPure database contains information on cosmetic ingredients compiled from publicly available sources. We strive to keep this information accurate and current, but:
- Product formulations may be changed by manufacturers at any time without notice to us
- Regulatory classifications and safety assessments evolve as new research emerges
- User-submitted product data undergoes review but may contain errors
- Regional product variations (different formulations sold in different markets) may not be fully captured
- We do not verify information directly with manufacturers unless publicly available
HowPure does not guarantee the accuracy, completeness, timeliness, or reliability of any information in the App. Always verify product information by checking the physical product label, especially if you have known allergies or health conditions.
5. What HowPure Is Not
For the avoidance of doubt, HowPure is not:
- A medical device: The App is not a medical device and has not been evaluated, cleared, or approved by any medical device regulatory authority.
- A diagnostic tool: The App does not diagnose skin conditions, allergies, or any other health conditions.
- A substitute for professional advice: The App does not replace consultations with dermatologists, allergists, pharmacists, or other qualified healthcare professionals.
- A product certification service: A high score in HowPure does not constitute a safety certification or endorsement of any product.
- An allergen testing service: The App cannot determine your individual allergies or predict allergic reactions with certainty.
6. Your Responsibility
By using the App, you acknowledge and accept that:
- You are solely responsible for decisions you make regarding cosmetic products based on information from the App
- You should always read physical product labels and not rely exclusively on the App
- You should perform patch tests when trying new products, especially if you have sensitive skin or known allergies
- You should consult qualified healthcare professionals for any health-related concerns
- You should seek immediate medical attention if you experience an adverse reaction to any cosmetic product
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MB “BD CONSULTING” (HOWPURE), ITS DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR ADVERSE SKIN REACTIONS, ALLERGIC REACTIONS, HEALTH COMPLICATIONS, OR ANY OTHER PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM:
- Your use of or reliance on information provided by the App
- Any inaccuracy, error, or omission in ingredient data, safety scores, or product information
- Any delay or failure in updating product information or safety assessments
- Any adverse reaction to a product that was rated, recommended, or not flagged by the App
- Your failure to consult a healthcare professional
Nothing in this disclaimer excludes or limits liability that cannot be excluded or limited under applicable EU or Lithuanian law.
8. Acknowledgment
By using the HowPure App, you acknowledge that you have read, understood, and agree to this Health & Safety Disclaimer. You understand that the App provides informational content only and that you use this information at your own risk and discretion.
This disclaimer is effective as of the date stated above and applies to all current and future features of the HowPure App that provide health- or safety-related information.
